Non-cognizable case filed against Mickky

MARGAO:  The Colva police on Monday registered a non-cognizable case against former rural development minister Francisco Xavier ‘Mickky’ Pacheco, who has been on the run over the 2006 assault case.

The complainant in the case Aires Rodrigues has been directed to seek appropriate orders from the court as the police are not empowered to investigate non- cognizable offences without the order of the court.

Judicial magistrate first class,  Margao, Pooja  Kavlekar on Monday commenced hearing arguments on the  petition filed by   Rodrigues seeking  directions to the Colva police to register an FIR  against Pacheco under Section 172 of the Indian Penal Code for  the offence of absconding to evade arrest. The hearing of arguments will continue on Tuesday.

Rodrigues urged the court to monitor the investigation of the case as Pacheco is a very influential politician.

He pointed out to the court that absconding to evade arrest is an offence punishable under Section 172 of the IPC. The petitioner stated that to shield the politically well connected   Pacheco, the police have intentionally avoided seeking orders of the court to register an FIR for the offence of absconding.

Meanwhile, a Colva police team, which has been camping in the national capital, visited the Supreme Court complex to check the movements of Pacheco.

Police sources said that review petition filed by the Nuvem MLA before the SC did not come for hearing.

The police team visited the Shakarpur police station at Laxmi Nagar east Delhi to seek its help in tracing Pacheco.
