Two get 7-yr jail for rape

MARGAO: The assistant sessions judge, Ms Sherin Paul on Thursday sentenced two persons, Mathew Gomes, a resident of Varca and Dumiyana Bhagat, who were arrested by Colva police in connection with the rape of a 26-year-old girl from St Jose de Areal.

The accused who were heard on the point of sentence have been sentenced to undergo seven years imprisonment and ordered to pay a fine of Rs 5000 in default or else to undergo one month simple imprisonment.
The judge has also stated in her order that if the fine is paid then it should be given to the victim. While Dumiyana Bhagat was held guilty under Section 109 of Indian Penal Code (IPC) for abetment Filipina Bhagat, sister of Dumiyana was discharged by the court earlier.
According to the prosecution, the mother of the victim from St Jose de Areal was approached by Filipina (sister of Dumiyana) on the pretext of providing a job to her daughter.
Accordingly, she decided to send her daughter with Filipina to Varca. Filipina then took the victim to her sister’s house, Dumiyana, who in turn on the same day took her to the accused Mathew
from Varca.
Police said that the accused Mathew on the pretext of giving her a job raped her for two days while Dumiyana was still present in the house. After this incident Dumiyana took the victim to Varca and asked her to go to Margao by bus.
After reaching home the girl narrated the incident to her mother following which a complaint was lodged with the Colva police.
Police inspector, Mr Edwin Colaco registered the offence against the three accused -- Mathew, Dumiyana and Filipina and the charge-sheet was sent in the court. The court examined in all eight witnesses including PI, Mr Colaco in support of the case. Public prosecutor, Ladislau Fernandes represented
the state.
