PANAJI/MARGAO: The Superintendent of Police (SP), Special Cell, Mr Atmaram Deshpande, revealed that a panel of doctors from Goa Medical College (GMC) and Hospital at Bambolim who conducted the medical examination of a 25-year-old Russian girl allegedly raped by a local politician confirmed that there were many bruises and injuries inflicted on her body.
Addressing the media, Mr Deshpande, informed that this was confirmed by the investigating police officer and added that an attempt to rape is as good as rape and since the crime branch has referred the case to the court, the matter came up for hearing on Monday at South Goa sessions court.
Mr Deshpande said at present the matter is subjudice and once the court gives its verdict, police will abide by it and if need be the accused would be taken into custody and would be placed under arrest and everything would follow like attachment of the car and other related things for investigation.
Meanwhile, arguments on the anticipatory bail application moved before Principal District and Sessions Judge, South Goa, Mr U V Bakre, by John Fernandes, accused by the Russian woman of attempt to rape were heard on Monday.
Public prosecutor, Ms T S Sardinha who appeared on behalf of the state argued that the incident took place on the night of December 1 when the victim who was with her friend, a girl, was offered a lift by the alleged accused Fernandes who allegedly raped her after dropping the other girl at her hotel.
Later the victim lodged a complaint with the police for which she was medically examined at Hospicio hospital, Margao where the report revealed that there were 13 injuries on her body with some on her fore arms and thighs. The female friend of the complainant had also filed an affidavit with the Colva police station.
The CID crime branch was later entrusted with the job of probing into the complaint filed by a Russian woman alleging rape by a Goan politician.
Ms Sardinha pointed out that the case needs to be investigated in detail considering the first and supplementary statements given to the CID by the victim vis-a-viz the contradictory affidavit filed by the female friend of the victim. It was argued by public prosecutor that vehicle in which they had travelled in has to be attached. Similarly the under
garments of the victim has to be attached in pachanama which is vital evidence.
Mr Rajiv Gomes who appeared on behalf of the alleged accused said that the FIR and supplementary statements brought two different sets of details and therefore could not be looked into.
He further said that victim kept on changing her statements. He also said that the vehicle is available and police has not done any thing to seize it. He said that the applicant is a reputed person and his entire career is at stake as he is being falsely implicated in the case.
Mr Gomes said that rape in the car means there could be injuries but with absence of injuries it is clear that the accused is not involved in the act.
With regards to the affidavit filed by the female friend of the victim at the Colva police station stating that such an incident had never occurred, he said that rape could be a cooked up story because the victim first did not said that she
was raped.
Meanwhile, CID has told the court that the accused is required for medical examination to assess the injuries on his body and also the clothes he was wearing on the day of the offence are required to be attached. They said that the offence is of serious nature and against foreign national and since the accused is having political links there is every possibility that pressure may be used on the witness.
