HC directs ousted Goa State Co-op Union chief to appear before RCS

High Court of Bombay at Goa has directed the petitioner Ramchandra Mule who has been ousted as chairman of the Goa State Co-operative Union to appear before the Registrar of Co-operative Societies (RCS) on November 2, at 10.30 am.

The court has said that the registrar thereupon if the petitioner makes a request to that effect will give an opportunity to him to submit his explanation on facts in writing and for explaining his defence and thereafter pass an order as per
law.

Mule has been ousted as chairman of the Goa State Co-operative Union as he was holding the post for over ten consecutive years.

As Mule has completed ten-year term on January 6, 2018, the Registrar of Co-operative Societies has issued an order that he will cease to hold the post of chairman of the Goa State Co-op Union. Mule had challenged before the High Court the order passed by the Registrar of Co-operative Societies dated February 26, 2018 holding that the petitioner has ceased to hold the post of chairman of the Goa State Co-operative Union Ltd, Panaji.

Senior advocate N Sardessai appearing for the petitioner submitted that the order is passed without reference to the facts and according to the petitioner, the conclusion reached at by the registrar is not warranted in the facts of the
case.

The senior advocate submitted that if the petitioner is given an opportunity to address the registrar, he will demonstrate from the record that the conclusion of the registrar was not warranted in law and on facts. The additional government advocate Faldessai has submitted that as per the record available with the registrar, a conclusion has been reached at by the registrar.
