Pacheco, Lyndon’s anticipatory bail pleas to be heard on Monday

PANAJI: Applications for anticipatory bail filed by the former minister for Tourism Mr Francisco Xavier Pacheco and Mr Lyndon Monteiro, apprehending their arrest, have been mentioned and will now come up for hearing on Monday, June 21 at 4.30 p.m. before Mr Justice A S Oka of the Bombay High Court at Goa.

On Friday, when the bail applications came before Mr Justice N A Britto, he did not hear the bail applications saying "not before me."

The applicants moved before the Chief Justice of the Bombay High Court to place the matter before another judge available in the High Court of Bombay at Goa who could hear the matter and accordingly the matter will now come up for hearing before Mr Justice A S Oka.

It may be recalled that after withdrawing the bail application filed by his mother on his behalf, Mr Lyndon Monteiro had filed a fresh bail application in the High Court.

Earlier, the applications filed by both Mr Pacheco and Mr Monteiro were rejected by the Additional Sessions Judge-1, Margao and therefore they have approached the High Court for anticipatory bail.

Mr Pacheco claims that the investigation is not being carried out in a fair and impartial manner and the investigation agency has not bothered to examine the possibility whether the deceased on her own voluntarily decided to end her life.

In his application he has also stated that the police have recorded the statement of Nadia at Jupiter Hospital, Thane and in her statement she has not involved the applicant in any manner.

The Additional Sessions Judge had also rejected the bail application of Mr Monteiro and while rejecting the same had observed that a young lady had lost her life and the circumstances under which she was shifted from one hospital to another, that too out of Goa, created doubt about the involvement of the applicant also because he was present throughout along with the family members of the deceased and had even helped them financially to pay bills of the hospitals as well as transport facilities.
