The Panaji women police on Wednesday filed a chargesheet against the former St Cruz MLA Atanasio ‘Babush’ Monserrate in the alleged 2016 minor girl rape case.
The police said the chargesheet has been filed before the district and sessions court, Panaji, under Section 376 (rape), Section 506 (criminal intimidation) of the Indian Penal Code, and also under the Protection of Children from Sexual Offences Act and the Information Technology Act for allegedly inducing children for online relationship.
Apart from Monserrate, one Rosy Ferros, who had allegedly introduced the victim and her mother to the former St Cruz MLA, has also been chargesheeted.
However, the police probe has found no evidence against the mother of the victim, and as such she has not been named as an accused in the case.
It is pertinent to note here that after registering the FIR, the police had arrested Monserrate, Ferros and the victim’s mother.
They were later released on bail.
Sources said the probe has found no evidence to prove the allegation that Rs 50 lakh had been paid to the mother, and that the girl had been administered stupefying substance.
The revelations on the alleged rape were made by the victim before the child welfare committee of the
Apna Ghar, and subsequently they were brought to the notice of the police.
The FIR was registered on May 4, 2016 on the basis of statements given by the victim in the presence of the child welfare committee.
The FIR was registered at the Panaji police station and subsequently transferred to the Panaji women police station.
Owing to two different birth dates, the police had referred the victim to the GMC for an ossification test.
The test had shown that the victim was 17-18 years old at that time.
